The property at 8 Brookhouse Road in Walsall has been at the heart of a planning row since 2022 when the council approved the application.

The proposals went through with the condition that a 45-degree line of sight from neighbouring windows would be preserved.

However, the drawings submitted with the application were later found to be inaccurate.

Walsall Council has now refused the application on the grounds that the front boundary wall and gates would impact visibility for pedestrians and drivers,

During construction, neighbour Sarbjit Bilkhu said the views from his property were obstructed and the council apologised to him for what it described as an ‘oversight’.

Walsall Council later served a Breach of Condition Notice on the owner but it was withdrawn because of the inaccurate plans.

Mr Bilkhu has accused Walsall Council of being too lenient over the handling of the case and has long called the works to be demolished.

The owner of number eight submitted a retrospective planning application to finally get the works approved. Five objections were received by the council for the latest plans.

Walsall Council has now refused the application on the grounds that the front boundary wall and gates would impact visibility for pedestrians and drivers, and the as-built property causes an unacceptable level of harm to occupiers at number six and is visibly incongruous.
