A 17-year-old from Stourbridge, who cannot be named for legal reasons, was charged with the manslaughter of the plasterer in September last year.
But, after denying the charge at Wolverhampton Crown Court, the Crown Prosecution Service has been forced to drop the case due to lack of evidence.
They were due to formally throw out the case today.
Simon's distraught mum May said: "The case was the only thing keeping us going since Simon's death."
She added: "We are just so devastated at the moment and so angry that justice has not been done.
"This trial would never have brought Simon back to us but it would have just given us a little bit of peace that the person behind it had been punished.
"We just can't believe that this could happen. We feel completely let down."
Around 200 mourners flocked to pay their respects to avid motorcross rider Simon at his funeral, and relatives said his death had left a void in their lives that could never be filled.
Simon, due to celebrate his 23rd birthday tomorrow, lived with his wife Cath and six-year daughter Shannon in Needwood Drive.
CPS spokesman Vinny Bolina said: "We explained the situation to the family.
"This decision was made in conjunction with counsel, police and a senior CPS lawyer who all agreed there was not sufficient evidence to proceed with this prosecution," the spokesman added.
