Driver in M6 crash which killed sons and aunt will not be prosecuted
A mother will not be prosecuted over a Christmas Day motorway crash in Staffordshire which caused the death of her two sons and her aunt, the Crown Prosecution Service said today.
Parveen Habib had been driving a Ford Focus when it crashed on the M6, close to junction 15 for Stoke-on-Trent last December.
The vehicle collided with the embankment. The 38-year-old's sons Adnan Habib, aged 10, and Mohammed Arsalaan Habib, four, together with her aunt Bushra Tazarib, 32, who had all been back seat passengers, died from their injuries.
They had been travelling from High Wycombe, Buckinghamshire, to a family wedding in Bolton. Other motorists alerted the emergency services and tried in vain to help the injured trio, but they were pronounced dead at the scene. The M6 was closed in both directions between junction 14 at Stafford and 15 for more than three hours.
Zafar Siddique, deputy chief crown prosecutor from West Midlands CPS, said: "This is an extremely tragic case of a mother, who was driving her family to a wedding on Christmas Day, losing control of her car. It resulted in a collision on the M6 motorway and as a result, her two young sons and her aunt, who were passengers in the car, all sustained fatal injuries."
He said there had been a detailed police investigation and Mrs Habib was interviewed voluntarily under caution, with a file being forwarded to the CPS. He said careful consideration had been given to the merits of pursuing a case before a decision was made that no prosecution should take place. Mr Siddique added: "Mrs Habib has lost both her sons and her aunt.
"I am satisfied that under these circumstances a prosecution is not in the public interest given the loss suffered by her actions, the effect that a prosecution would have on the surviving family members, and the fact that she does not present any continuing danger to other road users. Mrs Habib's momentary lapse of concentration that Christmas Day has had devastating consequences which will remain with her for the rest of her life. Our thoughts are with the family."
