The Co-op has launched a bid to block Tesco's plans to open a rival supermarket in Stourport – claiming it could ruin trade in the High Street.
Midland Counties Co-op has called for a judicial review claiming the decision to give the new store the go-ahead was flawed.
It says all issues were not fully considered when planning permission was granted. If a judge agrees, the matter could be heard in the High Court.
Spokesman for Midland Counties Co-op Adrian Barradell said today: "Midcounties has asked for leave for a judicial review as we believe that neither Tesco or the council have correctly followed the formalities of the planning process.
"Ultimately Stourport has to face the very real challenge to the vitality of its High St that a new Tesco will bring. We believe it is important that proper processes are adhered to."
Wyre Forest District Council has considered the application twice – and granted permission twice.
Council leader, Councillor John Campion, said: "Wyre Forest District Council has filed all the required papers with the High Court and is waiting for a decision from the court as to whether the Co-op should be given permission to continue with their application for judicial review."
