Anup Patel, 43, from Goldthorn Hill, struck Naresh Kumar as he tried to cross Dudley Road, Blakenhall, on March 3 this year.

The 50-year-old was hit shortly after midnight at the road's junction with Goldthorn Hill, known locally as the Fighting Cocks junction.

Patel was tested at the scene and recorded 44 micrograms of alcohol per 100 millilitres of breath. The legal limit is 35mg.

A subsequent investigation by West Midlands Police found his Toyota Yaris had been travelling at 49mph in a 30mph.

Mr Kumar was taken to Birmingham's Queen Elizabeth Hospital, but died later the same morning.

Patel, of Dudley Walk in Goldthorn Hill, pleaded guilty to causing death by driving without due care and attention while unfit through drink.

He was jailed for three years at Wolverhampton Crown Court on Friday.

Patel will also be banned from driving for four-and-a-half years following his release.

Sergeant Dean Caswell, from the force's Serious Collision Investigation Unit, said: "This was a tragic case of Mr Kumar being in the wrong place at the wrong time.

"Patel was not only speeding, but over the drink-drive limit. Sadly, nothing can bring Mr Kumar back and we can only hope this conviction will provide some crumb of comfort to his family."
