Family of Wolverhampton murder victim Tom Kirwan to lodge complaint over investigation

The family of murder victim Tom Kirwan say they feel let down by the system as his killer is still at large.

His heartbroken fiancée said they were planning to make a formal complaint to the Crown Prosecution Service about the lack of progress on the murder investigation.

So far, five people have been jailed for taking part in violence outside Wolverhampton's former Uberra nightclub in the early hours of July 8, 2012.

None of these defendants was involved in 23-year-old Mr Kirwan's murder, which happened at the same place and time as the street fight. Mr Kirwan's family, including his mother Emer Kirwan and his fiancée Jade Elwell, sat in on the cases – and said they had been emotionally draining to hear about what unfolded on the night in question.

Miss Elwell said: "We just feel devastated really about the whole situation. It just seems like there has been a whole catalogue of errors.

"We feel let down by the courts, the police and CPS.

"We are going to be making a formal complaint against the CPS and we will take it from there. We will keep fighting and fighting. Tom deserves justice, no matter how long it will take. I won't give up.

"We are not going to let this go as a family, we will look into this and fight."

West Midlands Police say they are determined to achieve justice for Tom.

Sergeant Mick Ross, from the Homicide Team, said: "This remains a live murder investigation and we are determined to secure justice for Mr Kirwan's family.

"Inquiries are on-going and I'd urge anyone with information about the stabbing to contact us on the 101 number." Today would have been Mr Kirwan's 26th birthday.
