Martin Piotrowicz, aged 21, saw the man approaching a drunk woman who was sitting in the middle of the road, Wolverhampton Crown Court was told.

She had just left the nearby Seven Stars pub in Cape Hill, Smethwick and the victim went to her aid fearing for her safety in the early hours of August 15.

"The woman was sat in the middle of the road and the man went to offer assistance," said Mr Howard Searle, prosecuting.

"The defendant was intoxicated and, wrongly believing the person was going to cause problems for the woman, punched him in the face.

"He then remained at the scene and was found to be in possession of a can of CS gas when arrested by the police," he added.

Mr Paul Mytton, defending, said: "It was a short incident and involved a single punch."

Piotrowicz from High Street, Smethwick, who had previous convictions for possession of a knife and battery, pleaded guilty to assault.

He was given a 26 week jail term suspended for a year with 100 hours unpaid work, and ordered to pay £200 compensation with £100 costs.

Recorder Stephen Thomas told him: "The person who was hit certainly did not deserve that kind of treatment."
