Van driver who caused death of cyclist on A5 in Staffordshire avoids immediate jail

A Cheslyn Hay driver who caused the death of a cyclist in Staffordshire has avoided jail.

Mr Maguire was taking part in a cycle tour from Basingstoke to Kendal with family and friends. He was ahead of them when he was struck by Swift's Transit van.

Swift was given a six month jail term, suspended for two years, and banned from driving for 12 months. He must also pay £2,000 in costs.

He had argued a gust of wind had forced his van into Mr Maguire's path before he hit him. But a jury at Stafford Crown Court convicted him last month after forensic investigators provided evidence which proved otherwise.

Mr Maguire was originally from Ireland and more recently lived in Perth, Australia. His family attended the five-day trial.

Senior Crown Prosecutor Andy Gee from West Midlands Crown Prosecution Service said: "The defendant's driving fell below that expected of a competent and careful driver, which tragically resulted in the death of Mr Maguire.

"Our thoughts are with the family and friends of Mr Maguire."
