Simon Galloway, of Old Fallings Lane, Bushbury, Wolverhampton, was seen putting the stub of his cigarette out of a window while stuck in traffic, a court heard.

Galloway was spotted by a Wolverhampton City Council compliance officer in his silver Ford Mondeo smoking on December 12 last year.

In the car behind him on the A454 Willenhall Road in Wolverhampton was the council worker who tracked Galloway down through the DVLA.

Mr Robert Marshall told Wolverhampton Magistrates' Court on Tuesday: "The defendant was seen to be smoking at around 1pm. The traffic was moving slow as there were road works in place at the time. The compliance officer saw Mr Galloway throw the cigarette out of his window and onto the highway. Following the incident the DVLA were contacted and they confirmed that the vehicle was registered to Mr Galloway."

Galloway didn't appear but wrote to the court to plead guilty to littering under the environmental act 1990.

Magistrates fined him £55 and told him to pay a £20 surcharge and costs of £150.
