Burglar who gagged disabled widow wins sentence cut

A burglar who gagged a disabled widow causing her to have an asthma attack during a raid on her home has had his custodial sentence cut by top judges.

Richard Markham was one of three thugs who broke into the 57-year-old woman’s house in Wolverhampton last December.

The 20-year-old, of Neve Avenue in Low Hill, was sentenced to four years in youth custody in June after pleading guilty to burglary at Wolverhampton Crown Court.

Following an appeal by his lawyers, top judges, Mr Justice Jack and Judge Martin Stephens QC, reduced the sentence to three years at London’s Court of Appeal.

Giving the judgment, Mr Justice Jack told the court how the sleeping victim had been alerted by her dogs.

She went to look and was pushed into a bedroom where she was held down with a gloved hand over her mouth, causing her to suffer an asthma attack.

One of the men brought her an inhaler, but then all three left with a Nintendo console and two phones.

Police caught Markham outside, but the others escaped.

Probation officers who interviewed Markham said that, although he accepted responsibility, he showed little insight into his behaviour.

Yesterday his lawyers argued that a four-year sentence for a young man of previous good character was “manifestly excessive”.

Mr Justice Jack said: “We consider that, taking account of the appellant’s age and his previous good character, a sentence of four-and-a-half years would have been appropriate following a trial.

“That will be reduced to three years to take account of his guilty plea.”

At the original hearing in June, Judge Rosalind Bush heard how the widow continued talking to her attackers.

She told them her husband had just died and the thugs replied: “He must have left you money then.”

    So whats the deterent, when scum like him, can walk into someones house and take what ever they want with very little punishment…The law is pathetic.It should have been forty years not 4 years or better still amputation of both hands so he won’t thieve again.

    move all criminals to where these judges & lawyers live problem solved what do you expect when the likes of Aso Mohammed Ibrahim are allowed by judges to stay in the uk because of his human rights after he killed a little girl while banned without a license and insurance fleeing the scene dont it make you want to cry

    British Justice.
    I live in Spain and read today about 4 thieves who tied up a woman and robbed her house. The have just been to court and got 89 years jail between them.

    It is time these judges lived in the real world not hiding in their fortress houses sometimes under Police potection with the panic alarm systems in place with instsnt response from the police. We pay their wages make them responsible to us.

    There are a lot of young people in Low Hill like those thugs. They complain that they are bored, but are too idle to attend school or find a job.

    Labour’s do-gooders have made the problem worse. Im 27, and when i was younger it was a disgrace to be on the dole. When labour came in, the thinking changed – lifestyle choice.

      Well Del-boy, I’m 47 and when I was younger there were lots of people on the dole and benefits because of high unemployment during the Conservative years (unemployment peaked at 3,300,000 in 1984). I knew lots of people who went through that entire period having never worked a single day. Crime was also at an all time high by 1993. So when you politicise this news report at east try and get your facts straight! By my reckoning you were about 14 years old when Labour went into Government in 1996 so what experience have you really had of a Conservative Government? How much did you really know about what was going on at 14 years old?

    Sentence should have been tripled. Again a weak useless judge. Shame these judges aren’t voted into office, then they might do as they are supposed to and keep criminals off the streets.

    Personally, I think a few lashes at the start of his sentence would be a good start – and I would volunteer to give them to him!

    I hope this judge gets broken into and is gagged and bound. These thugs need a lesson and need to be punished not slapped on the wrist to do it again. With all the cuts meaning less police, you’d think the judge would issue a sentence to stop the thug re-offending and wasting police and courts time!
