Grinning from ear to ear, Tobias Davies walks free from court after admitting attacking tragic Bilston teenager Shane Owoo.
Davies, aged 21, was yesterday given a 12-month jail sentence for taking part in an attack which eventually led to the death of the 16-year-old.
But he was able to walk out of the front door of Birmingham Crown Court because he has already served more than half of that time on remand.
Yesterday Christopher Lewis and Marvin Walker were jailed for five-and-a-half years for manslaughter, but will be free in two years. Davies was part of a gang which attacked the youngster in the Boswell Road area of Bilston as punishment for stealing a bike.
Shane, of Addison Place, The Lunt, was then taken to the nearby Lunt Pool, forced to jump in and prevented from getting out by a yob armed with a stick.
Davies was initially charged with the manslaughter of the youngster, but that charge was dropped when he pleaded guilty to assault.
Today Ann Nightingale, who co-ordinates a neighbourhood safety group on The Lunt, said: “It’s just sickening to think they’ll be out in two years, it’s a farce.”
The court heard yesterday that Davies, of Frost Street, Ettingshall, is now planning to start a new life with his mother in Scotland.

It’s amazing. Steal something from the rich and you go inside for years. be partly responsible for the death of a young man in a most cruel and savage way and you get six months. How can it be that a charge of manslaughter can be reduced to such an extent?
The law is an ongoing farce. the judges are failing to protect us and deserve nothing but our contempt.

Shame on all of those involved.The murderers and the people who stood by and watched and laughed as it happened, and who are still laughing now because they have gotten away with it.Shame on the courts for the lenient sentence.
no wonder these criminals arn’t scared of commiting crimes when they get pathetic sentences like these.

Stop the plea bargaining. This is how he walked..plead guilty to a lesser crime to save the court money. Wait until he does it again and then walks for a second time because he writes a letter of apology. Is it any wonder extremist political parties become popular when pc wimps and gravy train MPs are too frightened to act for fear or comment or loss of the gravy train.

I am from Glasgow but spent many years in Wolverhampton. Speaking on behalf of many parents that I know, we don not want this type of person in Scotland - just like you don’t want this type of person in Bilston! This man / thug / animal should have been incarcerated - no matter what, and not been left free to roam throughout the UK inflicting whatever punishment he felt necessary. Its about time the judges in these cases realised the effect it has on normal commmunities in Britain and took the respectable step of not lettting them go free. Whether or not this is the fault of the judge not having the powers or the criminal justice system gone wrong - it needs fixed - now!!!!

What a provocative image. As a mother this has made my blood boil. My upbringing has, however prevented me from crossing a very fine line between revenge and humanity….I know what I would do. We as readers can only speculate the values taught this piece of scum and we see it over and over again, day in day out. Life is cheap…dead or alive. What a legacy…..

Quite simply UTTERLY APALLING. What a sham our justice system is. It is beyond words. God for bid the victim was related to those making these decisions, I can’t help but think the sentence would be different then.

None of you were at court and do not know the full extent of what happened. The death is tragic and everyone wished the clocks could go back. I won’t comment on the sentence but will say the story you have been told is not the full truth. Christopher Lewis tried to save Shane along with Barry Graytex.
He pleaded guilty because he needed to right from the beginning. Chris has shown remorse from day one of the tragedy but sadly cannot bring back Shane. None of what happened was intended. Shane was not living at his family home for what ever but was living at the pool in a tent where he told Chris the stolen bike was that was the reason for going to the pool. It was the intent to make him get the bike, he was not forced into or kicked into the pool. But was told to he had to swim round it as a punishment for stealing the bike, smashing a van window. Then tragically the current took over. The 20 odd youths standing around the pool including some of the witnesses who lied and not been arrested were throwing stones and had sticks. Chris never hit him near the pool he tried to save him but the prosecution mentioned it a couple of times. The press NEVER mentioned it.
They edited what they wanted people to know. I would like to involve the government on this subject, they spend money on educating prisoners, but the schools let these men down. All of these boys have a known learning difficulty and have been removed from school. Gordon Brown should put the one to one educating facilities to the schools in stead of the schools kicking them out and they turn to believing they are useless and the streets get them.
This includes Shane, who I was a witness to his teaching away from the school as he himself had problems they should have been placed with higher learning needs and kept from the streets. None of this would have happened if they had the confident’s education, self worth, self esteem. It’s ok for everyone to sit down and do nothing except chastise them after things the event. The next generation will be the same because of the education system and the government. I am the mother of Chris. I do not in any way condone what has happened and truly feel for Shane’s mom and the family of which threatened to kill us in the court. They told us to remember their faces as they are coming to kill us. Yes I understand hurt and pain but isn’t that showing a worse approach that the boys did with Shane. That is classed as premeditated murder but I pray that does not take place.
I was not at the pool, I had no part in it, and yet I am subjected to evil words against me and my family. I prayed for my son as I am a Christian and God heard my prayers for lenience as I know it was not intended and remorse pain and hurt has been felt by my son from the beginning. The situation surrounding it will always remain in his mind. Nothing can move it. He tried to save Shane and the current was taking Chris and Barry so they had to get out but no one mentioned it. Yes society is sad but lets make a difference and try to make it better by doing something accept moaning. Find something to help the next generation so they can be educated not evicted from education and have to be taught in prison as Chris is doing. He is trying to gain what the school could not give. I do not condone Tobias walking free I no his part, God knows his part and he does. I will say nothing regarding this matter. My son may be serving a light sentence but he is serving what the judge has requested him to on the request of me to God. its remarkable that she goes on to chastise the education facilities and the education that her son and the others including shane recieved.
i fail to see the conection between the poor education and the events that happened.
we all have out own lives outside of the education system and our own actions, inactions and behaviours.
furthermore, interesting how she goes on to mention that “chris and barry attempted to swim into the pool and save shane”, however in the same sentance she writes “i was not at the pool, i had no part in it”.

Why do people always blame education!!! surley the parents are responsible for teaching their children right from wrong! not the schools! the only way the government is letting us down, is by not punishing offenders enough!!

I agree but you have not and will not see my son laugh or put his face on like that. And further more if you know God as I know God, you will no to well he is a forgiving God. I also know my son has turned to God and has asked forgiveness for what he has done. But I can completely understand where you are coming from and may be not bias but hurt. As we all are. On New Year eve my husband said it’s not a happy one is it. I replied No but I am thinking of Shane’s mom because her pain is greater. So please do not think we are like the grinning cat that may have no remorse. I cannot answer for him I can only answer for my son. I have spoken to Shane’s mom and explain how we feel that includes my husband and the family. We are sorry and nothing can bring Shane back. It should not have happened and would not have if Shane had not had been led by someone else to come onto my garden and do certain things. I wished the bike was not outside I wished many things and yes its not good to argue back and forth but I am truly speaking the truth about my son and how he feels. I can only say in time as I asked Shane’s mother she can find it in her hear to forgive. Some are saying an eye for an eye. How is it people are asking for another to die? It all has to stop. There is nothing we cando this things has happened and is tragic. Shanes mom has been hurt enough and needs all this to stop. his finger was raised not becasue of anything to do with the case but something someone shouted bilston mom. That was at the beginning and to the press not anyone else. Hence why the press keep showing the same photograph but people will only see what they want to wont they. But you know something I not worried about I know what is what.
